Terms of Service

These terms cover your use of Tendito, our AI phone and text receptionist and automation service for local service businesses. We have kept the language plain so you can actually read it. If anything is unclear, call or text us and we will walk you through it.

1. Acceptance of these terms

By using Tendito, or by signing an agreement with us to use Tendito, you agree to these Terms of Service. If you are agreeing on behalf of a business, you confirm that you have the authority to bind that business, and "you" in these terms means both you and that business. If you do not agree, please do not use the service.

2. The service

Tendito is software and a managed service for local service businesses. In plain terms, we provide an AI assistant that can:

The specific features available to you are set out in your agreement with us. We may improve, change, or retire features over time. We will give you reasonable notice of any change that materially reduces a feature you rely on.

3. Accounts and your responsibilities

To use Tendito you may need an account and access to a dashboard. You are responsible for keeping your login credentials confidential and for everything that happens under your account. Please let us know promptly if you believe your account has been used without your permission.

You agree to give us accurate information about your business, your services, your hours, and your scheduling rules, and to keep that information up to date. The AI relies on what you tell it, so the quality of its answers depends on the accuracy of the information you provide.

4. Acceptable use

You agree not to use Tendito to do any of the following:

If you misuse the service in a way that creates legal or operational risk, we may suspend or limit your access while we sort it out.

5. Your business stays responsible

The AI assists your business. It does not replace your judgment or your obligations. You remain responsible for your own commitments to your customers, for honoring the appointments and quotes made on your behalf, and for the services you deliver.

You are also responsible for the accuracy of the information you give Tendito, including your pricing, availability, service area, and policies. The AI works from that information and can occasionally make mistakes, so we recommend you review your bookings and your call records and keep a human in the loop where it matters. We are not responsible for decisions you make, or commitments you keep, based on the AI's output.

6. Telephony and SMS terms

Tendito works with your phone number and text line, usually by forwarding your existing number to the service. Because calls and texts are regulated, you agree to the following:

By opting in to text messages from Tendito or a Tendito-powered business line, you agree to receive messages such as appointment confirmations, reminders, arrival notices, follow-ups, and replies to your questions. Message frequency varies. Message and data rates may apply. You can opt out at any time by replying STOP (or STOPALL, UNSUBSCRIBE, CANCEL, END, or QUIT), and you can get help by replying HELP or contacting us at the number below. After you opt out, you will receive one final message confirming your opt-out and nothing further. Consent to receive text messages is not a condition of any purchase or service. 7. Third-party services

Tendito relies on third-party services to do its job, including Twilio for telephony and messaging and Google for calendar booking. You may also choose to connect your payments provider, such as Square or Stripe, as that capability becomes available.

Your use of those services is also subject to their own terms and policies. We are not responsible for third-party services, their availability, or their changes, and an outage or change on their side may affect Tendito. We will do our reasonable best to keep things running and to let you know when a third-party issue is affecting your service.

8. Fees and billing

Pricing for Tendito is custom. It is tailored to your business and to what you choose to automate, so there is no fixed plan. The fees, the billing period, and how you pay are set out in the agreement we reach with you, and you agree to pay them as described there.

Unless your agreement says otherwise, fees are exclusive of taxes, and you are responsible for any taxes that apply. Any third-party carrier or messaging fees described above are separate from what you pay us.

9. Service provided as is

We work hard to make Tendito reliable and useful, but the service is provided "as is" and "as available," without warranties of any kind, whether express or implied. To the fullest extent permitted by law, we disclaim the implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

We do not warrant that the service will be uninterrupted, error free, or that the AI's responses will always be accurate or complete. Phone and messaging networks, and third-party services, are outside our full control.

10. Limitation of liability

To the fullest extent permitted by law, Tendito and the people behind it will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any lost profits, lost revenue, lost business, or lost data, arising out of or related to your use of the service.

To the fullest extent permitted by law, our total liability for any claim arising out of or related to the service will not exceed the amount you paid us for the service in the three months before the event that gave rise to the claim. Some jurisdictions do not allow certain limitations, so some of these may not apply to you.

11. Termination

You may stop using Tendito and end your agreement as described in that agreement. We may suspend or terminate your access if you breach these terms, if your use creates legal or security risk, if a required third-party service is no longer available to us, or as otherwise set out in your agreement.

When your service ends, your right to use Tendito stops. We will handle any data associated with your account in line with our Privacy Policy and your agreement. Sections that by their nature should survive termination, such as fees already owed, disclaimers, and limitation of liability, will continue to apply.

12. Changes to these terms

We may update these terms from time to time, for example to reflect new features or changes in the law. When we do, we will update the "Last updated" date at the top of this page. If a change is material, we will make reasonable efforts to let you know. Your continued use of Tendito after a change takes effect means you accept the updated terms.

13. Governing law

These terms are governed by the laws of the State of New Jersey, USA, without regard to its conflict-of-laws rules. You agree that the state and federal courts located in New Jersey will be the venue for any dispute that is not otherwise resolved, except where applicable law gives you the right to bring a claim elsewhere.
